What Florida Law Now Requires of Condo and Co-op Associations
Senate Bill 4-D (2022) Florida’s landmark building safety law, imposes mandatory milestone structural inspections on condominium and cooperative buildings three stories or taller. Key requirements include:
- Phase 1 milestone inspection at 25 years (for coastal buildings) or 30 years (all others), then every 10 years thereafter
- Phase 2 structural integrity reserve study requirement, affecting reserve funding obligations
- Infrared electrical inspection required for buildings with main electrical service of 400 amperes or greater as part of the recertification package
- Deadlines with real consequences, buildings that fail to comply face building department enforcement, potential certificate of occupancy issues, and board member liability
